Membership Agreement and Privacy Policy

  3. Responsibilities:
    1. ENKA HOME Software and Trade reserves the right to change or discontinue any services, products, or information available on this website and its extensions without prior notice. Changes take effect as soon as they are published on the website. By using the website or accessing it, you are deemed to have accepted these changes. These conditions also apply to other linked web pages.
    2. The company agrees and undertakes that the member will benefit from the contractual services, except for technical failures.
    3. The User agrees in advance that they will not attempt reverse engineering in the use of the site or engage in any other activity aimed at finding or obtaining the source code of the site, otherwise they will be responsible for any damages that may arise before third parties, and legal and criminal action will be taken against them.
    4.     2. The User accepts and declares that, limited solely to being used for promotional, advertising, campaign, marketing, announcement, and similar activities, the company owning the Site may share their communication details, portfolio status, and demographic information with its subsidiaries or affiliated group companies. Such personal information may be used within the company to determine customer profiles, present promotions and campaigns suitable to customer profiles, and carry out statistical studies.
    3. Confidential Information may only be disclosed to official authorities in cases where it is duly requested by such authorities and where disclosure is mandatory under the provisions of the applicable mandatory legislation.
    4. No Warranty: THIS AGREEMENT CLAUSE SHALL BE VALID TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. THE SERVICES PROVIDED BY THE COMPANY ARE OFFERED ON AN "AS IS" AND "AS AVAILABLE" BASIS, AND NO EXPRESS OR IMPLIED WARRANTIES OF ANY KIND, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, ARE GIVEN REGARDING THE SERVICES OR APPLICATION (INCLUDING ALL INFORMATION CONTAINED THEREIN).
  6. Registration and Security
    1. The User must provide accurate, complete, and up-to-date registration information. Otherwise, this Agreement shall be deemed breached, and the account may be terminated without notifying the User.
    2. The User is responsible for the security of their password and account on the site and on third-party sites. Otherwise, the Company cannot be held responsible for any data losses, security breaches, or damages to hardware and devices.
  7. Campaign
    1. Users can only use one campaign or coupon code per order. Campaign and coupon codes cannot be combined.
    2. If ENKA HOME determines that fraud has been committed by using computers or internet technologies in a manner that negatively affects the results of the campaign, or that registrations have been created unfairly by any means, it reserves the right to cancel the relevant participations without any notice. Even if these individuals appear on the winners list, if any unlawful action or behavior is detected, all participation data of the participant will be deleted and the right to claim a prize will be forfeited. (Including social media campaigns.)
  8. Force Majeure
    1. If obligations under the agreement cannot be fulfilled by the parties due to reasons beyond their control, such as natural disasters, fires, explosions, civil wars, wars, uprisings, public movements, declarations of mobilization, strikes, lockouts, epidemics, infrastructure and internet failures, or power outages (collectively referred to as “Force Majeure” below), the parties shall not be held liable. During this period, the rights and obligations of the parties arising from this Agreement shall be suspended.
  9. Entire Agreement and Enforceability
    1. If any provision of this agreement becomes partially or wholly invalid, the remainder of the agreement shall remain valid and enforceable.
  10. Amendments to the Agreement
    1. The Company may partially or completely amend the services offered on the site and the terms of this agreement at any time. Amendments shall become effective as of the date they are published on the site. It is the User’s responsibility to follow these amendments. By continuing to use the services provided, the User shall be deemed to have accepted these amendments.
  11. Notice
    1. All notifications to be sent to the parties regarding this Agreement shall be made through the Company’s known e-mail address and the e-mail address specified by the user in the membership form. The User accepts that the address specified during registration is their valid notification address, and if it changes, they will notify the other party in writing within 5 days. Otherwise, notifications made to this address shall be deemed valid.
  12. Evidence Agreement
    1. In the event of any disputes arising from the transactions related to this agreement between the Parties, the Parties’ books, records, and documents, as well as computer and fax records, shall be accepted as evidence in accordance with the Turkish Code of Civil Procedure No. 6100, and the user agrees not to object to these records.
  13. Dispute Resolution
    1. For the resolution of any disputes arising from the implementation or interpretation of this Agreement, the İnegöl Courthouse Courts and Enforcement Offices shall have jurisdiction.
